Zach Caldwell Posted August 1, 2015 Report Share Posted August 1, 2015 AB, in the United States, the state allows ministers to perform marriages., However, as a result of our freedom of religion, the state cannot compel that minister to perform any marriage that violates his or her belief/ church practices. For example, in the Loving v. Virginia, which legalized interracial marriages, all government agents had to provide licenses. But churches could still refuse to marry an interracial couple. In fact there are still some churches today that refuse as is their right. Likewise, any minister or church right now can legally refuse to perform a marriage for a gay couple and no one will say anything about it. The right, is trying to extend religious freedom beyond what it is intended to do. If you are a state or federal employee you cannot refuse to do your legally sworn job on the basis of your personal religion.
